Steps

  1. Check whether your industry has a National Employment Council (NEC). If it does, its designated agent usually handles disputes in that industry.
  2. If it doesn't, take the dispute to the labour officer at your district labour office.
  3. The officer or agent tries to settle it with you and your employer. This is called conciliation.
  4. If it isn't settled, you get a certificate of no settlement. The case can then go to arbitration or the Labour Court.

Good to know

  • Act quickly. If you were dismissed or disciplined after a hearing under your workplace's code of conduct, you have two options (Labour Act, sections 101(5) and 92D). You can take it to a labour officer, but only within 30 days after the final decision. Or you can appeal straight to the Labour Court within its time limit. You must refer any other dispute within two years of it arising (section 94).
  • Ask the Legal Aid Directorate whether it can give you free legal help.
